General Terms and Conditions
Al Morshedy Marts
Preamble
Your use of the Al Morshedy Marts website constitutes your full and final agreement to these Terms and Conditions. The Company reserves the right to amend these terms at any time, and such amendments shall become effective immediately upon being posted on the website.
1 First: Eligibility and Website Use
- Use of the website is limited to persons who are 18 years of age or older.
- The website may not be used for any commercial purposes or on behalf of a third party without prior consent from the Company.
- The Company reserves the right to suspend or cancel any account that violates these terms.
2 Second: Registration and Account
- The client is obligated to provide correct and accurate data when registering or placing an order.
- The client bears full responsibility for maintaining the confidentiality of their account information.
- The Company has the right to suspend the account in case of any suspected illicit use.
3 Third: Orders and Confirmation
- All orders are subject to confirmation via text messages (SMS).
- No order will be shipped until final confirmation is received from the client.
- The Company reserves the right to reject or cancel any order without providing reasons.
4 Fourth: Prices and Payment
- All prices are in Egyptian Pounds (EGP) and include Value Added Tax (VAT), if applicable.
- The currently available payment method is Cash on Delivery (COD).
- In the event of a pricing error, the Company reserves the right to adjust the price or cancel the order.
5 Fifth: Delivery
- Delivery is carried out within the Arab Republic of Egypt according to the approved delivery policy.
- The client is obligated to be present at the specified address and answer confirmation calls.
- The maximum number of delivery attempts is two attempts only.
Important: In the event that both delivery attempts fail due to the client's absence or failure to answer, the order will be canceled automatically without any liability on the Company.
6 Sixth: Repeated Refusal to Receive
In the event that a client repeatedly refuses to receive orders without a valid reason, the Company has the right to:
- Suspend the Cash on Delivery service.
- Or suspend or cancel the client's account permanently.
7 Seventh: Product Inspection
The client is obligated to inspect the products upon receipt and before signing. No complaints regarding breakage or damage will be considered after the completion of the receipt process.
8 Eighth: Returns and Exchanges
- All returns are subject to the Company's approved Return Policy.
- Products must be in their original condition, unused, and in their original packaging.
- A return request must be submitted within a period not exceeding 14 days from the date of receipt.
- No return requests will be accepted after the specified period has elapsed.
- In the case of partial returns, the invoice will be calculated based on the products actually received (kept) after inspecting the returned items.
9 Ninth: Order Cancellation
- The client has the right to cancel the order before it goes out for delivery.
- After the order has gone out for delivery, the Company has the right to charge the client for the shipping cost.
10 Tenth: Intellectual Property Rights
All content on the website, including text, images, and trademarks, is owned by Al Morshedy Marts and is protected under intellectual property laws.
11 Eleventh: Limitation of Liability
The Company bears no responsibility for:
- Misuse of products after delivery.
- Any indirect damages resulting from the use of the website.
- Minor differences between the displayed images and the actual product.
12 Twelfth: Misuse of Promotional Offers
Al Morshedy Marts reserves the full right to:
- Cancel any orders resulting from the misuse of offers or discounts.
- Exclude the client from benefiting from future promotional offers.
- Suspend or cancel the client's account in the event of proven fraud or misuse.
This includes, but is not limited to, repeated cancellations, refusal to receive orders, or creating multiple accounts to benefit from the same offer.
13 Thirteenth: Termination of Service
The Company has the right to terminate or suspend the use of the website or accounts at any time without prior notice and without bearing any legal liability.
14 Fourteenth: Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws in force in the Arab Republic of Egypt, and the Egyptian courts shall have jurisdiction over any dispute.
